  1. Introduction and Acceptance

This Terms and Conditions document (“Terms”) governs your access to and use of the website located at MobilityMojo.com (the “Website”), operated by Mobility Mojo Limited (“Mobility Mojo”, “we”, “us”, or “our”). Mobility Mojo Limited is a company registered in Ireland (Company No. 546547), with its registered office at, Fleming Court, Fleming Place, Dublin, Ireland, DO4N4X9. By accessing or using this Website, you (the user, whether an individual or a business entity) agree to comply with and be bound by these Terms, as well as our Privacy Policy (incorporated herein by reference). If you do not agree to any part of these Terms, you must not use the Website.

By using the Website on behalf of a company or other organisation, you represent that you have authority to bind that entity to these Terms. These Terms apply to all visitors and users of our public Website, including potential B2B clients and any B2C visitors. Please note that if you become a client of Mobility Mojo and enter into our Master Services Agreement or other service contract, that agreement will govern the provision of our services and will take precedence over these Website Terms in the event of any conflict.

We reserve the right to update or modify these Terms from time to time. If we make material changes, we will post the revised Terms on this page with an updated revision date. It is your responsibility to review these Terms periodically. Continued use of the Website after any changes are posted constitutes your acceptance of the revised Terms.

  1. Definitions

For the purposes of these Terms, the following definitions apply:

  • “Website” means the website located at MobilityMojo.com, including any subdomains or sections thereof, and all content, features, and services made available on or through it.
  • “Mobility Mojo” (also referred to as “the Company”, “we”, “us”, or “our”) means Mobility Mojo Limited, the owner and operator of the Website.
  • “User” or “you” means any person or entity who accesses or uses the Website, whether as a visitor, prospective client, or otherwise. This includes “Clients” (businesses or individuals who register for or use our services via the Website or portal) and “Other Users” (persons who visit the Website without registering an account).
  • “Services” refers to the software, tools, reports, and services offered by Mobility Mojo, including the Accessibility Rating tool, accessibility audit toolkit, and any related services accessible through our client portal or Website.
  • “Master Services Agreement” or “MSA” means a separate agreement that Mobility Mojo may enter into with Clients for the provision of Services. The MSA contains specific terms regarding licensing of our software, service subscriptions, intellectual property rights, usage restrictions, confidentiality, and liability limitations pertaining to our paid Services.
  • “Content” means all materials on the Website, including but not limited to text, data, information, software, code, images, graphics, logos, videos, audio clips, design elements, and arrangements thereof.
  • “User Submissions” means any information or material that you submit to us via the Website’s features (such as contact forms, demo request forms, sign-up forms, or email links). This may include personal information, enquiries, feedback, or any other content that you voluntarily provide to us. (Note: the Website does not offer public forums or allow users to post content that is visible to others; all submissions are private communications between you and Mobility Mojo.)

Unless the context requires otherwise, words in the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

  1. Access to and Use of the Website

3.1 Permitted Use: We grant you a limited, non-exclusive, non-transferable, revocable licence to access and make personal or internal business use of this Website and its Content in accordance with these Terms. You may use the Website only for legitimate purposes, such as learning about our Services or communicating with us. All rights not expressly granted to you in these Terms are reserved by Mobility Mojo. We may at any time and without liability modify, suspend, or discontinue any part of the Website or the availability of the Website entirely, with or without notice (for example, for maintenance or updates).

3.2 Prohibited Conduct: When accessing or using our Website, you agree that you will not engage in any of the following activities:

  • Unlawful Use: Do not use the Website for any purpose that is illegal or prohibited by these Terms. You must not violate any applicable laws or regulations when using our Website.
  • Unauthorised Access: Do not attempt to gain unauthorised access to any portion of the Website, our servers, or any related systems or networks. You must not hack, attack, probe, scan, or test the vulnerability of the Website’s security measures without proper authorisation.
  • Interference: Do not interfere with or disrupt the operation of the Website. This includes prohibiting the introduction of any harmful or malicious code – you must not knowingly introduce viruses, trojans, worms, logic bombs or any other material that is technologically harmful. You also must not launch any denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against the Website.
  • Scraping and Automated Access: Do not use any robot, spider, scraper, crawler, or other automated means to access the Website or extract data or Content without our prior written permission. You also agree not to use the Website in a manner that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure.
  • Misrepresentation and Misuse: Do not misrepresent your identity or affiliation when using the Website. You must not impersonate any person or organisation, or provide false information. Additionally, you must not use the Website to transmit or upload any material that is defamatory, obscene, offensive, or otherwise objectionable (such as any content that is harassing, libellous, fraudulent, or infringing on others’ rights).
  • Unauthorised Reproduction of Content: Do not copy, reproduce, modify, or distribute any part of the Website or its Content except as allowed under Section 5 (Intellectual Property Rights) of these Terms. In particular, you must not reverse-engineer, decompile, or disassemble any software or technology underlying our Website or Services, nor attempt to derive source code or create derivative works from the Website’s software, except to the limited extent that applicable law expressly permits despite this prohibition.
  • Removal of Notices: Do not remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed on the Website or contained in any Content.

If you breach any of the above conditions, your permission to use our Website will immediately cease without further notice, and you may be liable for legal consequences under applicable law. Unauthorised access or tampering (such as hacking or introducing malware) is illegal; we may report such breaches to law enforcement authorities and co-operate with them by disclosing your identity or other relevant information.

3.3 User Submissions: While using the Website, you may have the ability to submit inquiries, personal details, or other information to us (for example, by filling out a “Contact Us” form or scheduling a demo via our Website). All User Submissions you send through the Website must be lawful, accurate, and not violate any third-party rights. By submitting any information or material to us:

  • You agree that you are solely responsible for the content of your submission and for ensuring it does not contain anything unlawful, confidential (of a third party), or infringing. You should not upload or send us any sensitive personal information or proprietary business secrets through unsolicited submission fields.
  • You grant Mobility Mojo a worldwide, royalty-free, and sublicensable right to use, reproduce, and process your submission for the purposes of addressing your request, providing our Services, or otherwise as reasonably necessary for our business operations. For example, if you submit a query or feedback, we may use that information to respond to you, improve our Website or Services, or keep a record of your request. We will handle personal data included in User Submissions in accordance with our Privacy Policy (see Section 6).
  • We do not publish or display User Submissions on the Website. There are no public forums or comment sections on our site for users to share content. As such, any information you submit is received by us privately. We reserve the right (but do not assume the obligation) to delete or disregard any User Submission that violates these Terms or that we determine in our discretion to be inappropriate, irrelevant, or harmful. We are not responsible to you or any third party for loss or damage resulting from our refusal to accept or act on any submission or from removal of any submission.
  • If you provide us with any suggestions, ideas, or feedback about our Website or Services (“Feedback”), you acknowledge that such Feedback is given voluntarily and we may freely use, implement, and incorporate it into our products or services without any obligation to you.

3.4 Availability: We strive to keep our Website operational and accessible, but we do not guarantee that the Website (or any Content on it) will be available at all times or uninterrupted. From time to time, access may be limited or suspended, including (but not limited to) for routine maintenance, updates, or technical improvements. Mobility Mojo will not be liable if for any reason the Website is unavailable at any time or for any period. We may also impose limits on certain features or restrict your access to parts or the entire Website without notice or liability.

3.5 Your Equipment and Connectivity: You are responsible for obtaining and maintaining all equipment, software, and services needed to access the Website (such as computers, mobile devices, internet service, and web browsers) and for any charges associated with your data usage. You are also responsible for ensuring that any persons who access our Website through your internet connection or device are aware of these Terms and comply with them.

  1. User Accounts and Login Credentials

4.1 Account Registration: Certain portions of our services (for example, the client portal or accessibility assessment toolkit) may only be accessible to registered users or Clients with an account. If you have entered into a service agreement with us (such as our Master Services Agreement), you or your organisation will be provided with login credentials for our portal. To register for an account (for example, to access a Mobility Mojo toolkit or dashboard), you must complete the sign-up or onboarding process provided by Mobility Mojo, providing accurate, current, and complete information as requested (such as your name, company details, contact information, and password). You agree to keep your account information updated and accurate at all times. We reserve the right to decline a new registration or to terminate an account that does not comply with these requirements or if we suspect the information provided is false or misleading.

4.2 Account Security: If you receive or set up a username, password, or any other piece of security information as part of our account security procedures, you must treat such information as confidential. You are responsible for maintaining the secrecy and security of your login credentials and for all activities that occur under your account. Do not share your password or allow any unauthorized person to access or use your account. If you are a business Client and you allow an employee or agent to use your Mobility Mojo account or toolkit on your behalf, you are responsible for ensuring that such person is authorised and is aware of and abides by these Terms (and any applicable service agreement).

4.3 Unauthorised Use: You agree to notify Mobility Mojo immediately at admin@mobilitymojo.com if you become aware of any unauthorised access to or use of your account or any breach of security. We are not liable for any loss or damage arising from your failure to comply with the above account security obligations. You may be held liable for losses incurred by Mobility Mojo or others due to someone else using your account as a result of your failing to keep your account information secure.

4.4 Our Access to Your Account: You acknowledge and agree that Mobility Mojo may access your account (including any data or information stored in it) as necessary for purposes such as technical support, maintenance, security monitoring, or other legitimate business purposes. For example, we may need to log into your account to assist with a support query or to investigate suspicious activity. Such access will be conducted in accordance with our Privacy Policy and security policies, and we will not use your account information for any purposes other than those permitted under these Terms, our contract with you (if you are a Client), or applicable law.

4.5 Suspension or Termination of Accounts: We reserve the right to suspend or terminate your user account at any time if, in our reasonable opinion, you have violated any provision of these Terms, if your account has been inactive for an extended period, if required by law enforcement or legal process, or for other reasons such as security issues or prolonged non-payment of fees (if applicable under a separate service agreement). Account termination will be handled as described in Section 9 (Termination and Suspension).

  1. Intellectual Property Rights

5.1 Ownership of Content: All Intellectual Property Rights in and to the Website and its Content are owned by Mobility Mojo or our licensors. This includes all software, code, databases, design, text, graphics, logos, trademarks, service marks, trade names, photographs, audio and video material, the selection and arrangement thereof, and all other material or content on the Website. These works are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Mobility Mojo and its licensors retain all rights, title, and interest in and to their respective Intellectual Property. Nothing in these Terms transfers any ownership of such rights to you.

5.2 Licence to Use Website Content: As stated in Section 3.1, we grant Users a limited licence to use the Website and its Content for its intended purposes. You may view, download (cache) or print pages from the Website for your own personal use or your internal business use, provided that you do not remove or alter any copyright, trademark, or other proprietary notices. Any copies of Content you make must preserve all such notices as they appear on our Website. This licence is granted solely for access and use under these Terms; it is conditional on your compliance with these Terms and is subject to the restrictions described herein.

5.3 Restrictions on Use of Intellectual Property: Unless you have our express prior written permission or as permitted by applicable mandatory law, you are NOT permitted to do any of the following with any part of our Website or Content:

  • Republish or redistribute Website Content (such as by reposting our articles on another site or using our text, images or code in a public-facing database).
  • Sell, resell, rent, or sub-license Content from the Website.
  • Reproduce, duplicate, or copy the design of the Website or any Content for commercial purposes. This includes framing the Website within another website, or mirroring our Content on any other server.
  • Modify or create derivative works based on the Website or its Content. You must not adapt, translate, or otherwise change any material from our Website without permission, except as necessary to view the material.
  • Use any of our trademarks, logos, or brand elements without our prior consent. All Mobility Mojo logos, product names, and slogans are trademarks of Mobility Mojo. You are not allowed to use our marks in any manner likely to cause confusion about the source of goods or services or in any way that disparages or discredits us.
  • Reverse-engineer, decompile, or disassemble any software or technology embodied in the Website or provided through our Services (except and solely to the extent that such activities are expressly permitted by law notwithstanding this restriction). You also must not attempt to extract the source code of any software on the Website or use any part of our code for creating a competing product.

Any use of the Website or Content beyond the scope of the limited licence granted by these Terms requires our express written consent. If you wish to make use of any materials on our Website beyond what is permitted here (for example, for marketing or publication purposes), please contact us to seek permission.

5.4 No Assignment of Rights: Except for the limited usage rights expressly granted above, nothing in these Terms shall be construed as granting you any license or rights in our Intellectual Property, whether by estoppel, implication, or otherwise. We reserve all rights not expressly granted. In particular, if you are a Client utilising Mobility Mojo’s accessibility toolkit or other Services, all Intellectual Property Rights in the toolkit, software, data, and reports remain vested in Mobility Mojo (or our licensors). You receive a licence to use those Service deliverables strictly as defined in your Master Services Agreement or other service contract. Any goodwill generated through your use of our Services or display of our marks inures to our benefit.

5.5 Feedback and Contributions: If you send us any Feedback (such as ideas for improvements or new features) or other voluntary contributions regarding our Content or Services, you agree that Mobility Mojo may use, disclose, and exploit such Feedback freely without any restriction or compensation to you. We have no obligation to implement Feedback or keep it confidential. To the extent any intellectual property rights in Feedback do not automatically vest in Mobility Mojo, you hereby assign all such rights to Mobility Mojo and agree to provide any assistance we may require to document or perfect our rights in the Feedback.

  1. Data Collection and Privacy

Your privacy is important to us. Our collection, use, and processing of personal data through the Website are governed by our Privacy Policy (available on our Website). By using the Website or submitting any personal information, you acknowledge that you have read our Privacy Policy and consent to the handling of your information as described therein. In summary:

  • Personal Data: We will collect and process certain personal data (for example, contact details, browser information, and usage data) when you use the Website or contact us. Any personal information you provide will be used in accordance with applicable Irish and EU data protection laws, including the General Data Protection Regulation (GDPR). We will not sell your personal data to third parties. We implement appropriate technical and organisational measures to safeguard the data we collect.
  • HubSpot and Contact Forms: Our Website uses HubSpot, a third-party Customer Relationship Management (CRM) and marketing platform, to manage contact forms, newsletter sign-ups, demo scheduling, and other user submissions. When you fill out forms on our site (such as to “Get Started” or “Schedule a Demo”), the information you provide (including personal data like your name, email, phone, company, etc.) will be transmitted to and stored by HubSpot on our behalf. HubSpot acts as our data processor for these purposes. We have ensured that HubSpot, as a service provider, is contractually bound to comply with GDPR requirements and to protect your data. By submitting your details, you consent to this processing. We use the information collected via HubSpot to respond to your inquiries, send you requested information, and for our internal business development purposes (such as tracking outreach and sales efforts).
  • Google Analytics: We use Google Analytics (and/or similar analytics tools) on our Website to collect information about how visitors use our site. Google Analytics uses cookies and similar technologies to track usage data such as page visits, browsing duration, referring pages, and general location of users. This information helps us analyse Website traffic and improve the user experience. To the fullest extent permitted under applicable law, Mobility Mojo disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not guarantee that the Website or any Content is error-free, complete, or up-to-date. In particular, any information presented on our Website (for example, blog posts, articles, case studies, white papers, or statistics about accessibility or business outcomes) is for general informational purposes only and should not be construed as professional advice or a guarantee of any result. No advice or information obtained by you from us (whether written or oral) shall create any warranty not expressly stated in these Terms.

7.2 Specific Acknowledgements: You acknowledge and agree that: (a) Use at Your Own Risk: Your use of the Website is at your sole risk. You are responsible for verifying any information obtained from the Website before relying on it, and for taking appropriate precautions to protect yourself and your devices from viruses, malware, or other harmful content that could be encountered via the Internet. (b) Technical Accuracy: While we endeavour to keep the Website available and the information accurate, we do not warrant that the operation of the Website will be uninterrupted or secure, or that the Content is accurate, reliable, or error-free. We may change or update the Content at any time, but we are under no obligation to do so. (c) No Client Relationship: Simply visiting our Website or reading its content does not create a business or professional services relationship between you and Mobility Mojo. (d) Third-Party Data: Any references to third-party standards, certifications, or data (for example, accessibility standards or studies on inclusion) are provided for context; Mobility Mojo is not responsible for the accuracy or completeness of information originating from third parties.

7.3 No Liability for User Decisions: Mobility Mojo will not be responsible for any decisions you make or actions you take based on the information provided on our Website. In particular, we do not exclude or limit liability for: (i) death or personal injury caused by our negligence or the negligence of our employees or agents; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability which cannot be excluded or limited under applicable law. Subject to the foregoing, the following limitations apply:

Business Users (B2B): If you are using this Website in the course of business or as a representative of a company:

  • Exclusion of Implied Terms: To the maximum extent permitted by law, we exclude all conditions, warranties or other terms which might be implied by law or otherwise (including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement) in relation to our Website or its Content.
  • Excluded Damages: Mobility Mojo will not be liable to you for any indirect, consequential, incidental, special, punitive, or exemplary damages whatsoever arising out of or in connection with your use of (or inability to use) the Website or the information on the Website. This exclusion includes, without limitation, any loss of profit, loss of revenue, loss of anticipated savings, loss of business or contracts, business interruption, loss of goodwill or reputation, or loss of data, even if we have been advised of the possibility of such damages.
  • Direct Damages Cap: To the extent you incur any direct losses or damages (for example, actual provable financial loss) and the above exclusion does not apply, then (except for the types of liabilities that cannot be limited by law as noted above) the total aggregate liability of Mobility Mojo to you for all claims arising out of or relating to the Website or these Terms shall be limited to the greater of: (a) the total amount (if any) you have paid to us in connection with the Website or Mobility Mojo’s services in the 12 months immediately preceding the event giving rise to the claim, or (b) EUR €100. This limitation applies whether such liability arises from breach of contract, tort (including negligence), strict liability, breach of statutory duty or otherwise.

Consumers (B2C): The Mobility Mojo Website is primarily intended for use by businesses. If you are accessing the Website as a consumer (an individual using the site for personal, non-business purposes), please note the following:

  • The information on this Website is provided for general informational and educational purposes and is not tailored to personal consumer needs. You agree that you are using the Website for domestic and private use only, and you will not use the Website for any commercial or business purpose. We shall have no liability to you for any business-related losses (such as loss of profit or revenue) since the Website is not provided to you for commercial use.
  • We do not supply goods or digital content for which consumer-specific warranties (such as those under consumer sales law) would normally apply; therefore, no such warranties are given. However, you retain all rights granted to you by mandatory consumer protection laws. Nothing in these Terms is intended to restrict the consumer rights that cannot be excluded or waived under law.
  • If, as a consumer, you suffer damage to computer equipment or other digital devices caused by content downloaded from our Website, and this is a direct result of our failure to exercise reasonable care and skill, you may be entitled to compensation or repair under statutory rights. However, please be aware that we take reasonable steps to prevent such issues (including using security measures and reputable third-party services), and you are expected to have in place up-to-date virus protection. We will not be liable for any damage that you could have avoided by following our advice to apply an update or use appropriate security measures, or for damage caused by your failure to correctly follow installation instructions or to meet the minimum system requirements for viewing our content.
  • Aside from any rights you may have under law, the limitations and exclusions of liability set forth for Business Users above also apply to you to the extent they are not prohibited by applicable consumer law. In particular, we still do not accept liability for loss of data, or for indirect and unforeseeable losses. And as stated, we do not exclude liability for death, personal injury, or fraud.

7.5 Third-Party Actions: Mobility Mojo shall not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, programs, data or other proprietary material due to your use of the Website, or to your downloading of any Content from the Website, or from any website linked to it. We recommend that you use your own appropriate virus-checking software and take regular backups of your data.

7.6 Reliance on This Website: You agree that you have not relied on any representation, warranty or statement made by us that is not explicitly set out in these Terms. If you are also party to a Master Services Agreement or other contract with Mobility Mojo, you acknowledge that any warranties or liabilities related to the performance of our paid Services are defined in that contract, and we will not be liable under these Website Terms for matters governed by the service contract.

The provisions of this Section 7 shall survive any termination of these Terms or your access to the Website.

  1. Third-Party Links and Tools

8.1 External Links: Our Website may contain links to third-party websites or resources that are not owned or controlled by Mobility Mojo. For example, our site may reference client websites, news articles, social media pages, or include links to scheduling platforms or partner sites. These links are provided for convenience and informational purposes only. We do not endorse and are not responsible for the content, products, services, or information on any external websites. If you follow a link to any third-party website, you do so at your own risk, and be aware that such sites have their own terms and privacy policies. Mobility Mojo disclaims all liability for any loss or damage that may arise from your use of or reliance on third-party websites.

8.2 Third-Party Tools and Features: In addition to external links, our Website may incorporate or enable certain third-party tools, plugins, or features to enhance functionality. Examples may include: embedded videos (e.g., YouTube or Vimeo players), interactive maps, or social media sharing plugins. While we select these tools to improve user experience, we do not have control over these third-party services or how they operate. Such tools are usually governed by the terms and privacy policies of the third-party providers. When you interact with these features, information about you (such as your IP address or usage behaviour) may be collected by the third-party provider. Use of third-party tools is at your discretion and risk. Mobility Mojo is not responsible for any issues arising from the use of third-party tools embedded in our Website, including the accuracy, reliability, or quality of any content or services provided by such third parties.

8.3 No Third-Party Responsibility: The inclusion of any link or third-party tool on our Website does not imply that Mobility Mojo endorses the third party or is affiliated with it. We do not assume any responsibility for the actions, products, or content of any third parties. If you leave our Website via a link or engage with a third-party service, you should carefully review the applicable terms and policies of those third parties. Any transactions you undertake with external providers (for example, if you follow a link to a payment gateway or an e-commerce site) are strictly between you and that provider, and Mobility Mojo shall have no liability arising out of or relating to those transactions.

8.4 External Integrations: If the Website in the future offers integration with third-party platforms (for example, signing in through a single sign-on service or pulling data from another application), such integration will be for your convenience. However, we cannot guarantee the ongoing availability or correct functioning of any integration. We may discontinue or change any third-party integration without entitling you to any compensation or notice.

  1. Termination and Suspension

9.1 Termination by Mobility Mojo: We reserve the right to terminate this Agreement (these Terms) or suspend your access to the Website at any time, for any reason, and at our sole discretion. Without limiting the foregoing, we may suspend or terminate your access (including any account you have) without notice if:

  • You materially or repeatedly breach any provision of these Terms. For example, if we discover that you have attempted to hack the Website, misused our Content, or violated intellectual property rights, we may immediately revoke your right to use the Website.
  • We are required to do so to comply with a legal requirement or court order (for instance, if a regulatory authority directs us to discontinue some or all of the Website or if laws change in a way that makes the Website unlawful or impractical).
  • We cease offering the Website or related Services to users in your region, or we decide to discontinue the Website entirely (for example, due to business reorganisation, merger, or the Website content being migrated to a new platform).
  • There are unexpected technical or security issues or problems. If we detect security breaches, fraudulent activity, or significant performance issues, we may suspend access to protect the integrity of our systems or the data.
  • Your account is associated with conduct that we believe violates our Master Services Agreement or other contracts you have with us (for instance, persistent non-payment under a service contract, or misuse of the client portal in violation of those contract terms).

In most cases, where reasonable, we will attempt to notify you (for example, via the email associated with your account) of any suspension or termination of access, and, where appropriate, attempt to resolve the issue with you before taking such action. However, we are not required to provide advance notice or an opportunity to cure a breach before terminating or suspending access in cases of serious or unlawful violations.

9.2 Effect of Termination: Upon termination of your access or this Agreement for any reason: (a) Your Rights End: all licences and rights granted to you in these Terms will immediately cease, and you must stop using the Website and any Content obtained from it. Any copies of Content you have downloaded or printed in violation of these Terms must be destroyed or deleted upon our request. (b) Continuing Obligations: termination will not affect provisions of these Terms which by their nature should survive, including but not limited to the sections on Intellectual Property (Section 5), Disclaimers and Limitation of Liability (Section 7), Governing Law and Jurisdiction (Section 10), and any other clauses which are stated to survive termination or which are necessary to interpret surviving clauses. All outstanding obligations or liabilities that arose prior to termination shall also remain in effect. (c) Accounts: if your user account is terminated, we may delete or anonymise all associated data we hold that is not needed for legal or legitimate business purposes, in accordance with our Privacy Policy. You will remain responsible for any obligations (such as fees or indemnification commitments) incurred before termination.

9.3 Voluntary Termination by You: If you no longer wish to be bound by these Terms, you may cease using the Website at any time. If you have an account and wish to deactivate or delete it, please contact us at admin@mobilitymojo.com or follow any account closure procedure available (if self-service account deletion is supported). Termination of your Website use will not automatically cancel any separate contracts you have with Mobility Mojo (for example, an ongoing subscription or Services Agreement) – you must refer to those contracts for termination procedures.

9.4 Service Agreements: For Clients who have entered into a Master Services Agreement or other service contract with Mobility Mojo: the termination or suspension of Website access under these Terms does not in itself terminate your Service Agreement (except where the cause of termination overlaps, such as illegal activity, in which case we may have rights to terminate the Service Agreement as well). Any termination of Services will be governed by the terms of the Service Agreement. Conversely, if your Service Agreement ends, we may immediately revoke any login credentials or client-specific access associated with that agreement, but you may still continue to use the public portions of our Website in accordance with these general Terms.

We shall not be liable to you or any third-party for any termination or suspension of your access to the Website made in accordance with these Terms.

  1. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Terms or your use of the Website shall be governed by and construed in accordance with the laws of Ireland. By using this Website, you hereby agree that, subject to the paragraph below, the courts of Ireland shall have exclusive jurisdiction to hear and determine any action or proceeding and to settle any disputes which may arise out of or in connection with these Terms or your use of the Website. You and Mobility Mojo each irrevocably submit to the jurisdiction of the Irish courts in respect of such matters.

If you are using the Website as a consumer and are habitually resident in another member state of the European Union, you may benefit from any mandatory provisions of the law of that country which apply to you. Nothing in these Terms (including the choice of Irish law as governing law and the submission to Irish jurisdiction) affects your rights as a consumer to rely on such mandatory local law or to bring a claim in the courts of your home country if and to the extent that is required by applicable consumer protection law. In all other cases, any disputes shall be litigated exclusively before the Irish courts, and you waive any objections to such venue on grounds of inconvenience or otherwise.

Additional Provisions

Entire Agreement: These Terms (together with any documents incorporated by reference, such as our Privacy Policy and any applicable Service Agreement terms for Clients) constitute the entire agreement between you and Mobility Mojo regarding your use of the public Website. They supersede and extinguish all prior understandings, agreements, or representations, whether written or oral, relating to the Website.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of Mobility Mojo.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed (removed) from these Terms. The remaining provisions of the Terms will continue in full force and effect and shall be interpreted so as to best accomplish the original intent of the parties (as reflected in the valid and enforceable provisions).

Assignment: You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. Mobility Mojo may assign or transfer its rights and obligations under these Terms to another entity in the event of a merger, acquisition, reorganisation, or sale of assets, or by operation of law or otherwise, and will notify you in such case as required by law.
